Board of Health Bans The Sale of Flavored Tobacco Products

The amended regulation promulgated at its April 8, 2019 meeting specifically bans the sale of “flavored” tobacco products except in “adult-only” retail tobacco establishments and “smoking bars”; both types of establishments restrict admission therein to individuals who can provide appropriate age verification.

This restriction specifically excludes “flavored” tobacco products with the aroma or taste of tobacco, mint, menthol, or wintergreen.  Other tobacco products not subject to this ban may be sold to purchasers age 21 and older by other establishments holding retail tobacco establishment permits which do not restrict admission to adults of a minimum age of twenty–one or are permitted as “smoking bars”.

The effective date of the amended regulation is May 2, 2019.
